PRODUCT DISCLAIMER & TERMS OF USE

Please read this Disclaimer carefully before purchasing or operating any SEMCO Equipment Sales (“SEMCO”) product. By proceeding with a purchase, you acknowledge and accept the terms stated below.

1. AS-IS CONDITION

All SEMCO machinery, attachments, and accessories are sold “as is”, without any express or implied warranties, unless specifically stated in writing. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow limitations on implied warranties; in such cases, the above limitations may not apply.

2. PRODUCT MODIFICATIONS

Any unauthorized modification, tampering, or alteration to SEMCO equipment voids all warranties and releases SEMCO from any responsibility. This includes structural changes, non-approved hydraulic or electrical installations, tuning adjustments, or attachment integrations not validated by SEMCO’s engineering team. SEMCO is not liable for damage, injury, or malfunction resulting from such actions.

3. COMPLIANCE WITH LAWS

It is the purchaser’s sole responsibility to ensure the lawful operation of SEMCO products in accordance with all applicable local, state, and federal regulations. SEMCO assumes no liability for fines, penalties, or damages resulting from the unlawful use, transport, or modification of equipment in any jurisdiction.

Operators must confirm that emissions, safety, and operational requirements are met before use in regulated environments or public areas.

4. CORRECT USAGE AND SAFETY

  • Operate all equipment strictly in accordance with the official SEMCO user manual provided at delivery.
  • Installation, maintenance, and servicing must be conducted by qualified professionals only.
  • Regular maintenance is required throughout the equipment lifecycle to ensure safe operation.
  • Operators must always wear appropriate personal protective equipment (PPE) including gloves, boots, helmets, and eye protection.

Failure to adhere to these requirements may result in injury, equipment failure, or property damage. SEMCO is not responsible for damages arising from negligence, misuse, or improper operation.

5. THIRD-PARTY PRODUCTS AND COMPONENTS

SEMCO does not assume responsibility for malfunctions or damages resulting from the integration of third-party products, attachments, or replacement parts not manufactured or certified by SEMCO. Compatibility and safety verification are the buyer’s responsibility. For optimal performance, only SEMCO-approved components should be used.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, SEMCO shall not be liable under any legal theory—whether in contract, warranty, negligence, strict liability, or otherwise—for any indirect, consequential, or punitive damages arising from product use or misuse.

  • Personal injury or death
  • Property loss or environmental damage
  • Business interruption or lost profits
  • Data loss or consequential operational costs

In all cases, SEMCO’s total liability shall not exceed the purchase price of the equipment or product in question.

7. WARRANTY EXCLUSIONS

  • Wear items such as belts, filters, seals, and fluids are excluded from coverage.
  • Failures caused by improper storage, non-compliance with maintenance schedules, or contaminated fuel/oil are not covered.
  • Environmental factors including rust, corrosion, flood, or lightning are excluded.

8. INDEMNIFICATION

By purchasing SEMCO products, the buyer agrees to indemnify and hold harmless SEMCO, its officers, employees, and affiliates from any claims, losses, or expenses (including legal fees) arising from product misuse, modification, or violation of law.

9. ENTIRE AGREEMENT & SEVERABILITY

This Disclaimer constitutes the entire agreement regarding SEMCO’s liability and product use. If any provision is found unlawful or unenforceable, it will be replaced by a valid clause that best reflects the original intent. All other provisions will remain in full force and effect.
